PixMaker Digital Services Terms of Use
Terms for the PixMaker app, web portal, subscriptions, AI features and other digital services

1. Scope of these Terms
These Terms of Use govern your access to and use of PixMaker's digital services, including the mobile app, web account portal, user account, device-management features, subscriptions, AI credits, AI generation, image conversion tools, digital content, rewards and related online services.
These Terms do not govern the purchase, delivery, return, refund, warranty or safety of physical PixMaker products. Those matters are governed by the terms shown in our online store and by the product instructions applicable to the physical product.
By creating an account, using the app or portal, purchasing a subscription or digital entitlement, or using a PixMaker digital feature, you agree to these Terms.
2. Company information
PixMaker digital services are operated by Pixply Ltd, a company registered in England and Wales under company number 16040467, with its registered office at Office One, 1 Coldbath Square, Farringdon, London, United Kingdom, EC1R 5HL.

3. Account eligibility
To create and control a PixMaker account independently, you must be at least 16 years old, or at least 13 years old in the United States, unless a different minimum age is required by applicable law.
A child below the applicable account age must not create an account or submit personal data through the app or portal. A parent or responsible adult may operate the account and digital services while supervising the child's use of the physical product.
4. Your PixMaker account
One PixMaker account may be used across the app and web portal. Depending on the services available to you, the account may show your plan, AI credits, registered devices, rewards, digital purchases, invoices and account settings.
You are responsible for keeping your login details secure, for providing accurate account information, and for activity carried out through your account. If you believe your account has been accessed without permission, contact us promptly.
5. Digital services and availability
PixMaker digital services may include app features, device pairing and management, image-to-pixel conversion, design editing, AI generation, digital libraries, account management, subscriptions, credits, rewards and support features.
Some features require internet access, Bluetooth, a compatible phone or browser, operating-system permissions, a supported app version, or third-party services. We do not guarantee that every feature will work on every device, browser, operating system or region.
We may improve, replace, add, limit or remove features as PixMaker develops. We will act reasonably where a change materially affects a paid digital service you have already purchased.
6. Subscription plans
PixMaker may offer paid subscription plans. The plan name, included features, AI credits, usage limits, billing frequency and price are shown before you subscribe.
Subscriptions are billed in advance using the payment method selected at checkout. Unless you cancel, the subscription automatically renews on the renewal basis shown when you subscribe, subject to mandatory local law.
You may cancel a subscription through the web portal or another cancellation method we make available. Unless applicable law requires otherwise, cancellation stops future renewals and takes effect at the end of the period already paid for. You keep access to the paid plan until that period ends.
If plan pricing or important subscription features change, we will provide reasonable notice where required. You may cancel before the change applies to a future renewal.
7. AI credits and one-time digital purchases
AI credits are limited-use digital entitlements that allow access to certain PixMaker features. Credits are not money, have no cash value, and cannot be transferred or exchanged for cash unless required by law.
Credits may be included in a subscription, purchased separately, or granted as a reward, bonus or promotion. The number of credits required for a feature is shown in the service where reasonably practical.
Plan-included credits may reset at the end of each billing period and may not roll over. Purchased credits generally remain available until used unless an expiry or other condition is clearly shown before purchase. Promotional credits may have separate conditions.
Credits used for a successfully completed AI generation or other digital action are consumed and are not restored merely because you do not like the result. If a generation fails because of a confirmed PixMaker service error, we may restore the affected credits.
8. Digital refunds and cancellation rights
Except where mandatory law gives you a different right, purchases of AI credits, digital content, one-time digital entitlements and completed AI generations are final and non-refundable once the digital supply has begun, the entitlement has been added to your account, or the service has been accessed, generated, downloaded or used.
Where applicable law provides a cooling-off or cancellation right for digital content or digital services, we may ask you to expressly request immediate supply and acknowledge that the relevant cancellation right may be lost once performance or supply begins.
Subscription cancellation stops future billing as described in section 6. Amounts already charged for the current subscription period are generally non-refundable except where required by applicable law or where we expressly agree otherwise.
9. Payments
Payments for subscriptions, AI credits and other digital purchases may be processed by third-party payment providers such as Stripe, PayPal, Apple or Google. Their own terms may also apply to the payment transaction.
We do not store full card numbers. We keep limited billing and transaction information needed to provide the service, show purchases or invoices, prevent fraud, provide support and meet legal obligations.
You are responsible for keeping your payment information valid. If a recurring payment fails, access to paid features may be limited or suspended until payment is successfully completed.
10. Image conversion and AI features
PixMaker may allow you to upload images, enter prompts, select settings and generate or convert designs. Results can vary and may not always be accurate, suitable, original or error-free.
You are responsible for reviewing outputs before using, publishing or selling them. You must have the necessary rights to any image, logo, artwork, character, photo, prompt or other material that you upload or use.
AI or converted outputs may unintentionally resemble existing works or protected content. PixMaker does not guarantee that an output is free from third-party rights.
11. Your content
You keep ownership of original content that you upload or create, subject to any rights held by third parties and to the nature of AI-generated output under applicable law.
You give Pixply Ltd a limited, non-exclusive permission to process, store, transmit, display, convert and technically handle your content only as needed to provide, secure, maintain and support the PixMaker digital services.
You must not upload, generate, convert, publish or use content that is illegal, harmful, infringing, deceptive or that violates another person's privacy, intellectual property or other rights.
12. PixMaker content and intellectual property
The PixMaker app, portal, software, interface, systems, branding, tutorials, official design libraries, templates and other PixMaker-provided digital content are owned by Pixply Ltd or its licensors.
Unless we clearly state otherwise, PixMaker-provided designs, templates and tutorials are licensed for personal use and may not be resold, redistributed or commercially exploited without permission.
This restriction does not transfer ownership of your own original uploads or user-created content to Pixply Ltd.
13. Acceptable use
You must not misuse the PixMaker digital services. In particular, you must not:

Break the law or infringe another person's rights;

Attempt to bypass account, payment, credit, usage or security controls;

Reverse engineer, scrape, copy, extract or interfere with the app, portal, software, databases or services except where the law expressly permits it;

Use automated or abusive methods that materially disrupt the service;

Upload or generate illegal, harmful, deceptive or infringing content; or
-
Use another person's account without permission.
14. Third-party services
PixMaker relies on third-party services such as app stores, payment providers, cloud hosting, AI processing providers, analytics providers, operating systems and communication services.
We are not responsible for outages, restrictions, policy changes or failures caused by third parties outside our reasonable control, although we will take reasonable steps to restore affected PixMaker services where practical.
15. Updates and service changes
We may release app, portal, software, security, compatibility or feature updates. Some updates may be required for continued use of a feature. Using an unsupported or outdated version may reduce functionality or security.
16. Suspension and termination
We may restrict or suspend an account or feature where reasonably necessary because of non-payment, fraud, security risk, unlawful use, infringement, abuse, a serious breach of these Terms, or a legal or platform requirement.
Where reasonable, we will give notice. We may act immediately where needed to protect users, the service, third-party rights, security or legal compliance.
You may stop using PixMaker digital services at any time and may request account deletion subject to data we must retain for legal, security, accounting or dispute-resolution purposes.
17. Service disclaimer
PixMaker digital services are creative support tools. We do not guarantee uninterrupted availability, perfect conversions, exact colour matching, perfect AI outputs, or compatibility with every device, image, browser, operating system or third-party service.
Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited.
18. Limitation of liability
To the maximum extent permitted by law, Pixply Ltd is not liable for indirect or consequential losses, loss of data, loss of content, loss of profit, business interruption or loss caused by misuse of the digital services.
Where liability may lawfully be limited, our total liability for a paid digital service is limited to the amount you paid for the digital service giving rise to the claim. This does not affect mandatory consumer rights or liability that cannot legally be limited.
19. Privacy
Our handling of personal data is described in the PixMaker Digital Services Privacy Policy. By using PixMaker, you acknowledge that your data will be handled as described in that policy and as required to provide the services you request.
20. Changes to these Terms
We may update these Terms as PixMaker develops or where legal, security, technical or commercial requirements change. If a change is material, we will provide reasonable notice through the app, portal, email, website or another appropriate method where required.
Changes do not remove rights that you already have under mandatory law.
21. Governing law and contact
These Terms are governed by the laws of England and Wales, unless mandatory consumer law in your country or region provides otherwise. If you are a consumer, any mandatory rights and protections available to you remain unaffected.
